I am the procurement director of a nut snack brand in Hangzhou. We finalized the supply of organic pecans from Chile last month, and this is our first import procurement. We previously contacted a small agency and almost encountered a major problem, as they did not even understand the access quarantine document requirements for nut imports. Fortunately, I checked in advance and avoided the pitfall. Now there are only 3 months left before the new product launch, and we are eager to find a reliable agency to implement the project, but we have no clue at all: for example, what are the special requirements for import quarantine of organic nuts? Will we be stuck by customs during customs valuation, leading to port detention? How to choose a logistics route to balance cost and timeliness? We also heard that VAT deferral can save a lot of capital costs, but we don't know how to operate it specifically. The more I think about it, the more anxious I am, for fear that another mistake will delay the launch of new products. I would like to ask how to do nut import agency well and what details should be focused on control?

First of all, accurate document review should be completed in advance, which is the core prerequisite for compliant customs clearance. It is necessary to focus on verifying the authenticity and validity of the Phytosanitary Certificate,Certificate of Origin of Chilean organic pecans,as well as the organic certification documents, especially to confirm that the nut variety, batch and exporter information on the certificates are completely consistent with those on the bill of lading and packing list,so as to avoid customs document review warnings caused by inconsistent documents.
Cross-departmental collaboration should be strengthened for the connection of core nodes: 72 hours before the arrival of the goods, the agency shall complete the pre-declaration,and simultaneously communicate with the customs inspection department in advance on the inspection requirements for organic products, for the logistics link, shipping companies with nut cold chain transportation qualifications shall be selected, and direct routes shall be locked to reduce transit risks, while the port free storage period shall be confirmed in advance to avoid container detention charges.
Exclusive abnormal response plans should be formulated: in case of customs valuation questions, complete supporting materials such as procurement contracts, payment slips and quotation sheets of overseas suppliers shall be submitted within 12 hours,in case of abnormal quarantine inspection, contact the local commodity inspection department for inspection at the first time, and simultaneously launch the backup source transfer plan to ensure that the new product launch will not be delayed.
In the final compliant implementation stage,it is necessary to complete the application for import quarantine certificate and archiving of all documents, ensure that the data are retained for no less than 5 years, and simultaneously connect with the financial department to complete the compliant declaration of VAT deferral,so as to optimize the capital cost.

Customs Declaration & Compliance ExpertStart a Chat
Customs declaration for nut import should focus on the valuation logic and compliance closed loop, especially for high-value products such as organic pecans, the customs will carry out multi-dimensional valuation referring to the import price of similar products in the same period, overseas supplier quotations, domestic market selling prices, etc. In case of valuation disputes, a complete trade supporting chain shall be submitted within 3 working days, including detailed clauses of the procurement contract, cost composition details of overseas suppliers, bank slips of foreign exchange payment vouchers, etc., so as to avoid being required to delete and re-submit the declaration due to incomplete data, which leads to increased port detention costs. At the same time, it should be noted that the customs declaration form for organic products shall be marked with the "organic" attribute separately, and the number of the corresponding quarantine certificate shall be filled in accurately to ensure the logical consistency between the customs declaration information and the documents.

For nut import logistics, priority should be given to shipping companies with nut cold chain transportation qualifications. For direct routes from Chile to Shanghai, liners with a voyage of 28-32 days should be selected to avoid the risk of cargo right transfer and cargo damage probability of transit routes. Before the arrival of the goods, the free storage period of the port shall be confirmed in advance. Generally, the free storage period for ordinary goods at Shanghai Port is 7 days, and for organic nuts, it can be extended to 10 days, and an application shall be submitted to the shipping company 3 working days in advance. In case of container rolling, switch to the subsequent liner of the same shipping company at the first time, and apply to the customs for an extension of the declaration period to avoid late declaration fees. The bill of lading endorsement shall be operated in strict accordance with the requirements of the letter of credit. In case of telex release bill of lading, it shall be ensured that the overseas supplier has completed the written confirmation of the telex release authorization to avoid cargo right disputes.

The VAT deferral declaration for nut imports needs to meet three core conditions: first, the goods are directly imported into the domestic bonded warehouse or designated supervision place; second, the enterprise has the qualification of general taxpayer and has completed the customs paperless declaration filing; third, the import agency agreement has been signed to clarify the VAT declaration responsibility. During operation, the pre-filing of VAT deferral shall be completed before the arrival of the goods, and materials such as import contracts and copies of bills of lading shall be submitted to the tax department simultaneously to avoid being unable to enjoy the deferral policy due to untimely filing. In addition, the import tariff rate of organic pecans is 10%, and the zero tariff preference under the China-Chile Free Trade Agreement can be enjoyed with the certificate of origin. It is necessary to ensure that the issuing date of the certificate of origin is earlier than the bill of lading date, and the goods information on the certificate is completely consistent with the customs declaration form.

The nut import agency agreement shall clarify three core clauses: first, the time node of cargo right transfer. It is recommended to agree that the cargo right will be transferred after the goods arrive at the port and complete the customs release, so as to avoid cargo damage risk caused by early transfer; second, the scope of the force majeure clause, which shall clearly cover common risks in cross-border trade such as port strikes and customs policy adjustments, and agree on the loss sharing proportion at the same time; third, the intellectual property protection clause, which shall clearly require overseas suppliers to provide trademark authorization documents for nuts, so as to avoid customs detention of goods caused by infringement. In addition, if letter of credit settlement is adopted, the soft clauses of the letter of credit shall be strictly reviewed, such as avoiding uncontrollable clauses such as "payment can only be made after the buyer confirms the sample".

Three preparations shall be made in advance for on-site inspection of nut imports: first, submit the inspection application for organic products to the customs in advance, and clarify that the inspection location is the designated organic product inspection area of the customs, so as to avoid cross contamination caused by mixed inspection with ordinary goods; second, prepare the authenticity identification materials of seals to ensure that the seal number of the container is completely consistent with the number on the bill of lading. If the seal is damaged, take photos for retention at the first time and verify the situation with the shipping company; third, prepare the sample inspection materials. If the customs requires inspection, submit the samples to the designated quarantine institution within 24 hours, and follow up the test progress simultaneously. If the test result is qualified, submit the test report to the customs within 3 working days to complete the release procedures.

The packaging of imported nuts shall meet three core requirements: moisture-proof, pressure-proof and pest-proof. Organic pecans shall be packed in food-grade vacuum packaging, and the outer layer shall be reinforced with corrugated cartons. The cartons shall be marked with organic product identification, country of origin, batch number and other information. At the same time, MSDS documents that meet the requirements of Chinese customs shall be prepared, which shall clarify the composition of nuts, storage conditions, transportation precautions and other contents, so as to avoid cargo detention caused by non-conforming MSDS. If container transportation is adopted, moisture-proof desiccants shall be placed inside the container, 8-10 packs per 20-foot container. At the same time, check the tightness of the container to avoid cargo damage caused by container water leakage. In addition, the shipping mark on the package shall be completely consistent with the information on the bill of lading and packing list, so as to avoid inspection caused by inconsistent shipping marks.

The supply chain planning for nut imports shall be linked with inventory and sales data. It is recommended to adopt the import mode of "small batch and multiple batches". For the import cycle of Chilean pecans, lock the shipping schedule 3 months in advance, and reserve 15 days of safety stock in the domestic bonded warehouse to avoid stockout caused by logistics delay. It is recommended to adopt the trade term CIF Shanghai Port, where the overseas supplier is responsible for transportation and insurance. At the same time, it is agreed that if the goods are damaged during transportation, the supplier shall be responsible for claiming compensation from the insurance company to reduce its own risks. Cost calculation shall cover all links such as tariff, value-added tax, logistics fee and agency fee, establish a dynamic cost model, track the changes of exchange rate and tariff policy in real time, adjust the import plan in time, and realize the optimal control of cost.
