We have a batch of devices with lithium batteries that need to be exported to Mexico. The freight forwarder said that we must obtain the UN38.3 certification, otherwise the Mexican customs will detain the goods. Is this certification mandatory? What are the consequences if we don't have it? And how should we proceed with the customs clearance process?

The UN38.3 requirements for lithium batteries and products containing lithium batteries are mandatory in Mexican customs, based on the Montreal Convention and Mexico's own NOM-024-SCFI standard. You must provide UN38.3 test reports,MSDSs,and transportation declarations issued by an accredited laboratory. If these documents are missing, the goods will be immediately detained by customs upon arrival at Mexican ports or airports, and you will face high storage fees, return shipments,or even destruction. It is recommended to confirm with Mexican importers before shipping to avoid the risk of double compliance requirements.

From the perspective of logistics operations, the UN 38.3 report is an essential document for air and sea freight of lithium battery goods. You need to provide the report, MSDS, and transport certification to the freight forwarder 3-5 working days in advance for the airline or shipping company's dangerous goods declaration. When clearing customs in Mexico, these documents must be submitted together with the commercial invoice and packing list. It is recommended to choose an experienced Mexican dedicated freight forwarder, who can pre-review the documents to avoid customs clearance delays due to non-compliant documents. Additionally, if the batteries in the equipment are removable, consider transporting them separately, which can sometimes reduce overall risks.

This requirement is actually a great opportunity for you to demonstrate your professionalism to Mexican clients. You can specify in the contract: "To ensure the smooth customs clearance of the goods, we will provide a full set of UN38.3 certification documents, which are mandatory requirements of the Mexican customs and also part of our commitment to product quality." This approach not only demonstrates professionalism but also reasonably incorporates the certification costs into the quotation. If the client is importing for the first time, you can proactively offer to assist them in understanding the Mexican import process, thereby establishing a deeper trust relationship. Regarding payment methods, it is recommended to make the certification documents a key point in the letter of credit or payment process to ensure the interests of both parties.
