I am the person in charge of a daily necessities export enterprise in Yiwu, Zhejiang Province. Last week, I finalized an order worth RMB 800,000 with 3 chain supermarkets in Ghana, and the containers will be loaded for shipment next week. However, the local Ghanaian freight forwarder I previously cooperated with suddenly lost contact, and I was so anxious that I stayed up all night. I heard that Ghana's customs clearance rules are strict, and port detention and customs seizure of goods occur frequently. Choosing the wrong agent will not only incur high port detention fees, but may even lead to goods confiscation. I am worried that I cannot find a Ghanaian import agent with formal customs clearance qualifications, and also afraid of encountering illegal agents who take away goods or charge exorbitant prices. I would like to ask what reliable import agency companies there are in Ghana, preferably those that can handle customs clearance of daily necessities and provide door-to-door full-link services?

When many foreign trade enterprises choose Ghana import agents, they are prone to the misunderstanding of "prioritizing only low prices",only looking at the agent's quotation while ignoring its formal qualifications, which is the most common source of risks.

If you accidentally choose an unqualified illegal agent, first of all, goods will be detained at the port due to non-compliant customs clearance documents. The port detention fee at Ghana's Tema Port doubles every day,and goods that have not been cleared for 30 days will be publicly auctioned,if the agent takes away customs clearance documents, goods will be directly seized by customs, and even face the chain risk of being confiscated by customs. Not only will the goods worth RMB 800,000 be lost, but you will also completely lose the supermarket customer resources in Ghana.

Physical risk isolation measures start from two points: first, require the agent to provide formal customs clearance qualification certificates issued by Ghana Customs and local warehousing cooperation agreements, second, verify the agent's compliant operation records through the Ghana Commercial Office in China.

Exclusive loss reduction tips: add a port detention compensation clause when signing the agency agreement, clarifying that if port detention is caused by the agent's operational errors, the agent shall bear all port detention fees,at the same time, connect with 1-2 backup agents in advance,so that you can switch immediately once the main agent loses contact.

When selecting Ghana import agents, you should focus on verifying their professionalism in HS code classification for Ghana Customs. Ghana Customs has extremely strict review of HS codes. If the agent makes classification errors, it will directly trigger valuation disputes and secondary declaration procedures, and goods will be moved to the exclusive inspection area for detention, resulting in additional inspection fees and port detention fees, and may even be identified as false declaration, with a fine of 10%-20% of the goods value. In addition, you should require the agent to assist in pre-reviewing domestic export documents in advance to ensure that the goods name and quantity on the commercial invoice and packing list fully meet the requirements of Ghana Customs, so as to avoid the risk of document rejection caused by inconsistent documents. If the agent has the "pre-classification qualification" of Ghana Customs, it can complete HS code pre-audit in advance, which greatly shortens customs clearance time.

When choosing Ghana import agents, you should pay attention to their linkage capacity with local ports in Ghana. Ghana's Tema Port and Takoradi Port often experience overbooking and container dumping. If the agent lacks priority container lifting resources at the port, goods may have to wait 7-10 days to be lifted after arriving at the port, and container detention fees are charged 20-50 US dollars per day according to container types. In addition, you should confirm whether the agent has local warehousing allocation capacity. If goods cannot be cleared immediately, they can be temporarily stored in customs supervised warehouses to avoid goods being moved to public open yards and damaged by rain. At the same time, require the agent to provide full-process cargo ownership monitoring services, and all container lifting and transshipment instructions must be confirmed by domestic export enterprises to avoid the agent disposing of goods without permission.

When connecting with Ghana import agents, you should focus on their planning capacity for Ghana import value-added tax (VAT). The current import VAT rate in Ghana is 12.5%. If the agent is not familiar with Ghana's VAT deferral policy, enterprises need to pay full import VAT at the time of customs clearance, which occupies a large amount of cash flow. In addition, some Ghanaian agents will illegally charge "tax agency fees" but fail to complete tax declaration, resulting in enterprises being listed in the abnormal list by tax authorities when carrying out business in Ghana in the future, affecting customs clearance of subsequent orders. You should require the agent to provide tax agency qualifications issued by Ghana's tax authority, and clarify the time limit and responsibility for VAT declaration in the agreement to avoid fines and credit risks caused by tax problems.

When choosing Ghana import agents, you should verify their compliant operation capacity for cross-border foreign exchange receipt and payment. Ghana implements foreign exchange control policies, and all import payments must be settled through payment channels recognized by the Bank of Ghana. If the agent uses offshore accounts for illegal foreign exchange settlement, domestic enterprises may face the risk of being unable to verify received foreign exchange, which affects subsequent export tax rebates. In addition, you should require the agent to assist in reviewing the foreign exchange payment license of Ghanaian importers to ensure that importers have obtained foreign exchange purchase quotas from the Bank of Ghana, so as to avoid payment arrears caused by insufficient foreign exchange. At the same time, confirm that the agent is familiar with Ghana's localization requirements for SWIFT messages to ensure that payment message information is completely consistent with customs clearance documents, so as to avoid fund suspension caused by inconsistent messages.

When signing a cooperation agreement with Ghanaian import agents, you should clarify the node of cargo ownership transfer and responsibility division. Some illegal agents in Ghana will set "vague cargo ownership clauses" in the agreement, claiming that cargo ownership will be automatically transferred to importers after customs clearance is completed. If importers default on payment, domestic enterprises cannot recover goods through legal channels. In addition, a force majeure兜底 clause should be added to clarify that if customs clearance delays are caused by force majeure such as sudden changes in Ghana Customs policies and port strikes, the agent shall promptly notify domestic enterprises and assist in applying for port detention fee reduction. At the same time, require the agent to provide agreement compliance review opinions issued by local Ghanaian law firms to avoid the agreement being invalid due to non-compliance with Ghana's local laws.

When selecting Ghana import agents, you should pay attention to their response capacity for on-site inspection. The inspection rate of daily necessities by Ghana Customs is as high as 40%. If the agent lacks on-site inspection experience and cannot quickly respond to customs requirements for goods name verification and quantity counting, inspection time will be extended by 2-3 days, resulting in additional inspection service fees and port detention fees. In addition, you should require the agent to prepare auxiliary documents such as goods origin certificates and quality inspection reports in advance. If customs requires inspection, relevant materials can be submitted as soon as possible to avoid goods being detained due to lack of documents. At the same time, confirm that the agent has the ability to identify the authenticity of seals, so as to avoid goods loss caused by replacement of container seals.

When connecting with Ghana import agents, you should confirm their compliance review capacity for goods packaging. Ghana Customs has strict requirements for the packaging of imported goods. If the packaging of daily necessities does not meet Ghana's moisture-proof and drop-proof standards, and goods are damaged during port transshipment, the agent may refuse to take responsibility on the grounds of "unqualified packaging". In addition, you should require the agent to assist in reviewing the MSDS report of goods (if involving chemical daily necessities) to ensure that packaging marks meet Ghana's dangerous goods transportation specifications, so as to avoid goods being seized by customs due to inconsistent packaging marks. At the same time, confirm that the agent has local packaging reinforcement capacity. If packaging is damaged after goods arrive at the port, emergency reinforcement can be carried out in supervised warehouses to avoid affecting customs clearance and distribution.

When choosing Ghana import agents, you should evaluate their accurate calculation capacity for full-link costs. The fees of Ghana import agents usually include multiple links such as customs clearance fees, warehousing fees and distribution fees. Some agents will hide miscellaneous fees such as "port construction fees" and "terminal distribution fees", resulting in the final import cost exceeding the budget by 15%-20%. In addition, you should require the agent to provide a full-link cost calculation sheet based on CIF trade terms, clarifying the charging standard and payment node of each fee to avoid subsequent disputes. If the agent has supply chain inventory linkage capacity, it can adjust customs clearance and distribution time according to the replenishment plan of Ghanaian supermarkets, reduce the retention time of goods in local warehouses and lower inventory costs.
